PMO Fitness Member Contract
This Gym Membership contract (hereinafter referred to as the "Agreement") is made and shall be effective as on January 1, 2026 (hereinafter referred to as the "Effective Date"),
By and between
PMO Fitness (hereinafter referred to as the "Gym" or PMO Fitness), located at 2 Railroad Ave E Pearson, GA 31642 and PMO fitness Member (hereinafter referred to as the "Member").
The Gym and the Member are collectively referred to as the "Parties" and individually as the "Party".
Health Attestation:
The Member attests that they are fully able to participate in an exercise regimen of design or choosing without undue risk. Members must be cleared by their doctor before becoming active if they are under restrictions from exercise (you must be free of all physical restrictions before becoming active)
Terms & conditions
Membership fees & Member Access
A. Membership Fee’s: The Member “has to” pay the Basic, Premium or bulk membership plus tax, to avail the facilities of PMO Fitness. The Minimum term period for a premium or bulk memberships is 6 months. Fees may be paid by automatic debit or credit card transactions or Bank Account. All monthly dues will require an 8% tax fee. Cancellation. If a member wishes to cancel their membership before the minimum term period, The Member “has to” pay a cancellation fee of $350. B. Member Access: The “Agreement” entitles the member access to PMO FITNESS so long as all dues are current. If a member fails to make their schedule payment the Access key will be denied. PMO Fitness is for Members Only, no Guest. All Guest must pay the $10 daily pass. PMO Fitness access keys are available only for Premium & Bulk members. To replace or buy an access key fog is $30. Location: 2 Railroad Ave E, Pearson, GA operating Days/Hours: Monday-Thursday 10:00 Am – 4:00pm.
Assumption of Risk and Potential Liability
C. The Member acknowledges and agrees that there are risks involved with any fitness and physical activity, the use of exercise equipment, and participation in an exercise program, and such risks may include the risk of serious bodily injury or death. By signing this agreement, the Member knowingly and voluntarily assumes all risks of liability, loss, illness, death, or injury caused or arising out of any use of the Facilities or the participation in any activities by the Member.
Litigation if a member fails to make their Membership payment or cancellation fee, the member will go into litigation. This means members are required to pay all court fees and additional charges owed to PMO Fitness.
Miscellaneous
A. Damages The Member shall pay for any damages. This includes the equipment or premises of the Gym, which results from the poor conduct of the Member or its guests.
B. Lost Goods The Gym takes no responsibility for lost or stolen goods. Lost and found goods not claimed after 10 days will be donated to charity or thrown away.
C. Binding This Agreement shall be considered binding upon the Member and the Gym. All legal proceedings in lieu of the Agreement shall be resolved by the jurisdiction laws of the state of Georgia.
D. Notices All notices, apart from cancellation notice, can be made to the Parties through a certified mailing address as mentioned in the Agreement. Any additional address shall be notified to the Parties in writing and in person.
E. Governing Law This Agreement hereto shall be governed and interpreted in accordance with the laws of Georgia.
Entirety This Agreement and other annexures, therefore, constitute the entire agreement between the Parties with respect to the matter of subject hereof and thus, supersedes all prior agreements, purchases, understandings, and negotiations, written or phonated, between the Parties.
